UNDERAGE DRINKING AND DRIVING
The Law
The State of Utah has strict underage drinking and driving laws. In Utah, it is unlawful for a person under the age of twenty-one years to drive or be in physical control of a motor vehicle while there is any amount of alcohol in the person's body.
Under Age DUI is essentially the same as a regular DUI (see Driving Under the Influence) except the driver is under the age of 21 and could find themselves charged additionally with Under Age Drinking. In an Under Age Drinking charge, the City or State needs to prove that the person is under 21 years of age and had alcohol in their body at the time of arrest. This is also known as "Not a Drop Violation" which is a misdemeanor offense punishable up to 90 days in the County Jail and $750 fine.
